- SUBJECT AND SCOPE OF THE AGREEMENT
- This Distance Selling Agreement (“Agreement”) has been concluded in accordance with the Consumer Protection Law No. 6502 (“Law”) and the Regulation on Distance Contracts. The parties declare that they accept and understand the obligations and responsibilities arising from the Law and the Regulation on Distance Contracts.
- The subject of this contract is the purchase of goods or services offered by the seller through electronic orders placed via the Yakup's.co platform owned by Yakups Tekstil Turizm Sanayi ve Ticaret Limited Şirketi, as well as the sale and delivery of these goods or services in accordance with the provisions of the Law and Regulations and the specifications stated in the contract.
- The conclusion of this agreement does not preclude the application of the terms of the subscription agreement separately concluded between the parties on the Yakup's.co platform, and the parties acknowledge that Yakup's.co is not a party to the sale of goods or services and has no responsibility or commitment regarding the fulfillment of the obligations under this agreement.
- DELIVERY OF GOODS AND DELIVERY METHOD
- The contract enters into force upon electronic acceptance by the buyer, and the obligation is deemed fulfilled upon delivery of the goods or services to the buyer at the address and to the authorized persons specified in the order form and in this contract.
- DELIVERIES AND RETURNS
- Once the order is completed, the buyer's requests will be processed for delivery preparation, and after order confirmation, the products will be handed over to the shipping company within a maximum of ………… business days. The shipment status can be tracked using the tracking number sent to the buyer. The products will be delivered by the shipping company chosen by the seller. Shipping costs and, if applicable, insurance fees will be added to the invoice amount, and the buyer undertakes to pay these in advance.
- The seller is not responsible for any damage that may occur during shipping and delivery. The buyer has the right to refuse acceptance of the product if damage is noticed upon delivery. In case of damage caused by shipping, the buyer must obtain a damage report prepared by the shipping company representative before signing the delivery receipt and return the product with the report. Otherwise, responsibility for the damage passes to the buyer and the return will not be accepted. If a defect is detected in the product before it is shipped to the buyer, the product... The exchange and reshipment of the product to the buyer will be completed within a maximum of 7 (seven) business days from the date the product arrives at the seller's warehouse. If the product cannot be purchased, the seller will refund the amount paid to the buyer in accordance with the terms of this agreement.
- DELIVERY AND INSTALLING COSTS
- Unless otherwise stated, delivery costs are borne by the buyer. If the seller states on their website that they will cover the delivery costs, these costs will be borne by the seller. Delivery will be made within the specified time after payment is received. In the event that delivery is not possible due to objective reasons, the seller will inform the buyer within 3 (three) days of learning of the situation and will refund the amount received within 14 (fourteen) days at the latest from the date of notification.
- If payment is not made or is cancelled in the bank records, the seller is relieved of the obligation to deliver the goods or services. If the buyer cancels the order after the product has been shipped, they are responsible for covering the shipping costs.
- BUYER'S STATEMENTS AND WARRANTIES
- The buyer declares that they have noted and electronically confirmed the information regarding the essential characteristics of the goods or services, their price and payment methods, as well as delivery and shipping costs. Complaints can be submitted through the seller's contact information or via the "My Account > Product Questions" section on the website.
- The buyer confirms that before signing the contract, they have received all necessary information from the seller, including the address, product specifications, price including all taxes, and payment and delivery methods. The buyer is obligated to accept any damaged or obviously defective products upon delivery. If a credit card is used without the buyer's consent, the buyer must return the product within 3 (three) days and cover the return shipping costs.
- SELLER'S REPRESENTATIONS AND WARRANTIES
- In accordance with consumer legislation, the seller is obligated to deliver the goods or services in good condition, complete, with warranties and instructions, and according to the specifications stated in the order.
- In the event of force majeure or extraordinary circumstances preventing timely delivery, the seller will inform the buyer within 3 (three) days of becoming aware of the situation. If the product is delivered to a third party, the seller is not liable if that party refuses to accept the product.
- RIGHT OF WITHDRAWAL
- The buyer may exercise their right of withdrawal within 14 (fourteen) days of receiving the goods, or, in the case of services, within 14 days of the date the contract is concluded, without giving any reason or penalty. Withdrawal may also be made before delivery of the goods.
- The return process is initiated by logging into your account at Yakup's.co, going to "My Account > My Orders," and clicking the "Return" link. The buyer must fill out the return form and send the product within 10 (ten) days of the notification date. The product must be returned in perfect condition, including the invoice, original packaging, all standard accessories, and any gifts received.
- If the product is returned via the shipping company contracted by the seller, the return shipping cost is as follows: The shipping cost is covered by the seller. If another shipping company is used, the return costs and risks are the responsibility of the buyer.
- Payments for the product or service will be refunded to the buyer within 14 (fourteen) days of receipt of the refund, without any additional charges, using the same payment method originally used. For purchases made on credit, the amounts will be refunded to the account associated with the credit.
- Situations in which the right of withdrawal cannot be exercised
- The buyer cannot exercise the right of withdrawal in the following cases:
- • Products manufactured according to the buyer's personal requirements or needs and which cannot be returned;
- • Products that are perishable or easily damaged;
- • Products whose packaging or seal has been opened after delivery, especially products related to health or hygiene;
- • Products that get mixed up and cannot be separated after delivery;
- • Services were initiated with the buyer's consent before the expiration of the cancellation period;
- Also excluded are products and services offered on a periodic basis, such as food, beverages, travel services, accommodation, restaurants, and entertainment.
- PRICE OF GOODS/SERVICES
- The sales price, whether paid in cash or in installments, is the price stated on the order form, confirmation email, and invoice issued to the buyer. Any discounts, coupons, or delivery fees are included in the final price.
- DELAYS AND LEGAL CONSEQUENCES
- In the event of a delayed credit card payment, the buyer will be liable to the issuing bank for any interest and additional charges as per the card agreement. The bank may initiate legal proceedings and claim damages and attorney fees; the buyer, in turn, will compensate the seller for any losses incurred due to the delay.
- ANNOUNCEMENTS AND SAMPLE CONTRACT
- Except in cases required by law, all communication between the parties will be conducted through the "My Account > Product Questions" section on the website or via email.
- The Buyer acknowledges that, in accordance with Article 193 of the Code of Civil Procedure, the official registers, databases, and electronic records of the Seller and Yakup's.co shall constitute final, binding, and exclusive evidence in any dispute.
- DISPUTE RESOLUTION
- According to the Distance Selling Contracts Law and Regulation, the seller is solely responsible for the goods or services sold. Buyers can submit their complaints directly to the sellers or through Yakup's.co. Yakup's.co will provide support in resolving issues, but the ultimate responsibility lies with the seller.
- The courts and enforcement offices of Istanbul shall have jurisdiction over any disputes relating to this contract and its annexes.
